Count I was founded on common law negligence and Count II on the Structural Work Act. (Ill. Rev. Stat. 1967, ch. 48, sec. 60 et seq.) Count II was dismissed on defendants motion on December 18, 1968, on the ground it did not state a cause of action under the Act. The order stated:
